Agreement to Terms

By accessing or using PrivateBroker's platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform.

Use License

Permission is granted to temporarily access and use the PrivateBroker platform for personal or business purposes related to private money lending transactions. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the platform materials
  • Use the materials for any commercial purpose outside of legitimate lending activities
  • Attempt to reverse engineer any software contained on the platform
  • Remove any copyright or proprietary notations from the materials
  • Transfer the materials to another person or mirror the materials on any other server

User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms. You are responsible for safeguarding your account password and for any activities or actions under your account.

Platform Purpose

PrivateBroker is a platform designed to facilitate connections between private money lenders and borrowers. We are not a lender, broker, or financial institution. All lending transactions and agreements are made directly between users. PrivateBroker is not a party to any loan agreements.

User Responsibilities

For Lenders

  • Ensure you have legal authority to lend money
  • Conduct your own due diligence on borrowers and properties
  • Comply with all applicable lending laws and regulations
  • Ensure all loan documents are legally binding and enforceable

For Borrowers

  • Provide accurate and complete information about your financial situation
  • Ensure you can meet repayment obligations
  • Provide truthful information about properties securing loans
  • Comply with all terms of loan agreements

Prohibited Activities

You may not use our platform to:

  • Engage in fraudulent activities or misrepresentation
  • Violate any local, state, or federal laws or regulations
  • Infringe on intellectual property rights
  • Transmit viruses or malicious code
  • Harass, abuse, or harm other users
  • Collect user information without consent

Limitation of Liability

PrivateBroker shall not be liable for any damages arising from the use of or inability to use the platform, including but not limited to direct, indirect, incidental, punitive, and consequential damages. We do not guarantee the accuracy, reliability, or completeness of any information provided by users.

Indemnification

You agree to indemnify and hold harmless PrivateBroker and its affiliates from any claims, losses, damages, liabilities, and expenses arising from your use of the platform or violation of these Terms.

Termination

We may terminate or suspend your account and access to the platform immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the platform will immediately cease.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the platform after changes constitutes acceptance of the new Terms.
